While it's true that both were snubbed in Foreign Language for different reasons, it all comes down to how the Academy realizes how ridiculous their Foreign Film Rules are.
They've been doing it forever, just remember how they nominated all the international directors in the 70s and how they gave Almodóvar an Oscar in 02 after his country failed to submit his film.
I also find it interesting that both in 02 and 07, they nominated the directors from the films they would've wanted the country (Spain and France) to submit and then took revenge on the films the countries ultimately chose and snubbed them in the Foreign category.

There is precedent, sort of.
